TITLE IX SHOWDOWN: FEDERAL JUDGE RULES AGAINST TRANSGENDER STUDENT PROTECTIONS

In a significant setback for the Biden administration, a federal judge has struck down a rule aimed at shielding transgender students from discrimination in educational institutions. US District Judge Danny Reeves in Kentucky delivered the ruling, citing conflicts with Title IX, the federal law prohibiting sex-based discrimination in education.

The judge sided with six Republican-led states, arguing that the Department of Education’s rule wrongly prohibits distinctions based on sex. Reeves asserted that expanding the definition of “sex” to include “gender identity” would essentially turn Title IX on its head.

Critics of the rule claimed it would force schools to allow transgender students born male to use women’s restrooms and locker rooms. Reeves also noted that the rule would infringe upon educators’ free speech rights and religious freedoms under the First Amendment.

This ruling marks the first permanent decision to strike down the policy, which could face repeal under the administration of President-elect Donald Trump. Tennessee Attorney General Jonathan Skrmetti hailed the decision as a “huge win” for women and girls across America.
